Septic inspections are often required because a property is being sold with a septic system and it is necessary to have one when a property is sold, divided or combined. We recommend that if you are going to sell a property with a septic system that you have the septic inspection conducted early in your sale process. If it highlights problems with your system you have time to have it fixed, if you choose to do so, without it impacting your sale timeline. If you pass with no problems that is just another positive selling point for your property. It is worth noting that if your septic system fails its inspection the owner or operator of the system is the legally responsible party required to upgrade the failing system. Prior to transfer of the property, this is typically the seller. Often, the buyer and seller work out the financial issues as part of the sale of the property. Title 5 does not require that a system be in passing condition prior to the sale, but most lenders will not issue a mortgage until the failing system is upgraded or funds to perform the upgrade are escrowed. Inspections required in connection with a property transfer generally are good for two years. If a property is sold more than once in the two-year period, the single inspection is valid for all transfers. When a system is pumped on an annual basis and the pumping records are available, an inspection is valid for three years. Therefore there really is no benefit in delaying having your inspection done if you are selling your property.

Cesspool Services and Replacement in Massachusetts Today

Down to Earth Down to Earth Construction Services has cesspool services and a cesspool replacement scheduled today in Stoughton, Bridgewater, Canton, Taunton, Berkley and Carver, MA.  As written on the Massachusetts Official Website of the Executive Office of Energy and Environmental Affairs:

 

“A cesspool is a pit which acts as both a settling chamber for solids and a leaching system for liquids. The use of cesspools may overload the capacity of the soil to remove bacteria, viruses, and phosphorus, and to nitrify ammonia and organic nitrogen compounds. A conventional septic system has a tank where solids can settle and begin to degrade, a distribution box, and a soil absorption system (SAS) that further treats the effluent by removing some of the bacteria, viruses, phosphorus, and nitrogen.”

 

To sell a property you need a Title 5 Inspection to be done. Title 5 does not require that cesspools be replaced however as stated on the Massachusetts Official Website of the Executive Office of Energy and Environmental Affairs:

 

“cesspools that exhibit signs of hydraulic failure, are located extremely close to private or public water supplies, or otherwise fail to protect or pose a threat to public health, safety or the environment will need to be upgraded (310 CMR 15.303). Also, cesspools must be upgraded prior to an increase in design flow (e.g., the addition of a bedroom to a home or seats to a restaurant”.
