Whether it is your first home or your fifteenth there is always a lot of moving parts to coordinate and this is doubly true if you are also selling a property at the same time. If the property your are buying or selling also has a septic system you are required in Massachusetts to have a Title 5 Septic Inspection on that system before Title transfer can take place. As stated on the Mas Gov website:
“The property owner or operator is responsible for arranging the inspection. The buyer and seller may change the responsibility for arranging the inspection prior to title transfer, provided that this change is put in writing and that the inspection still occurs within the specified timeframes.
The purpose of the inspection is to determine if the system in its current condition can protect public health and the environment. The inspection does not guarantee that the system will continue to function adequately, or that the system will not fail at a later date. This is particularly important if you plan to increase the flow to the system.
The inspection includes determining the location and condition of cesspools, septic tanks and distribution boxes. Often, this will not require extensive excavation.”

Many septic system problems are actually problems associated with the leach field and not the septic tank. Most people who have a septic system know they have a septic tank and where it is located but many do not realize the importance of a leach field to their septic system. Here are some ways to avoid problems:
- Never park a car or heavy equipment over your leach field.
- Don’t have heavy items or traffic on your leach field
- Have your septic tank pumped regularly (every 3-5 years usually). Sludge overload near the drain field can result in sulfite and bio-mat buildup
- Don’t pour grease, oil or fats down your sink
- Never plant any new trees or large plants or bushes near your leach field

Within 2 years before a sale. If weather conditions prevent inspection at the time of a sale, the inspection must take place within 6 months afterward.
When there is a proposed change to the facility which requires a building or occupancy permit.
Any change in the footprint of a building, to make sure that new building construction will not take place on top of any system components or on the system’s reserve area.
For large systems with a design flow of 10,000 to 15,000 gallons per day or more at full build-out, on the basin schedule shown in 310 CMR 15.301(6), and every five years thereafter.
Every 3 years for shared systems.
When the property is divided, or ownership of 2 or more properties is combined.

Most of the inspections that we carry out for property owners are for people who are selling their property and need their septic to be inspected before Title transfer can take place. However what some people do not realize is that we also carry out voluntary septic assessments. Property owners can hire a licensed inspector to perform Confidential Voluntary Septic Assessments of their septic systems. These inspections are completed just as they would be according to the Title 5 Inspections required by the State of Massachusetts, but the findings are NOT reported to any other person, municipality or office outside of the homeowner. Once the inspection is complete, the homeowner will receive a thorough report along with an assessment of the findings and some recommendations on how to properly maintain or repair their septic system. The recommendations provided by Down to Earth Construction Services are designed to increase longevity and prevent future issues, such as property damage, high cost repairs or system replacement.

The d-box, or distribution box, essentially connects the septic tank to your leach field or drain field. It ensures that the separated effluent is evenly ‘distributed’ over your leach field where it harmlessly enters your soil. If your d-box is broken or incorrectly installed this process will not happen correctly which can result in bad smells or puddling in your yard resulting from your waste not being treated correctly. We were contacted by a property owner who had recently inherited an older property with a failing cesspool which was processing the home’s wastewater. To enable them to easily and quickly sell the property for a good price they decided that it would be advantageous to replace the cesspool for a new, efficient septic system. A cesspool is a pit which acts as both a settling chamber for solids and a leaching system for liquids.
