Title 5 Septic Inspections For Commercial and Private Property

Down to Earth Construction Services have Title 5 Septic Inspections scheduled today in Franklin, Blackstone, Bellingham, Wrentham, Plainville and North Attleboro MA. In Massachusetts a septic inspection is required in the following instances:

 

  • Within 2 years before a sale. If weather conditions prevent inspection at the time of a sale, the inspection must take place within 6 months afterward.

  • When there is a proposed change to the facility which requires a building or occupancy permit.

  • Any change in the footprint of a building, to make sure that new building construction will not take place on top of any system components or on the system’s reserve area.

  • For large systems with a design flow of 10,000 to 15,000 gallons per day or more at full build-out, on the basin schedule shown in 310 CMR 15.301(6), and every five years thereafter.

  • Every 3 years for shared systems.

  • When the property is divided, or ownership of 2 or more properties is combined.

  • When MassDEP or the local Board of Health orders an inspection

A Title 5 Septic Inspection Determines A System’s Current Condition

Down to Earth Construction Services have Title 5 Septic Inspection appointments scheduled today for customers in Plainville, North Attleboro, Wrentham, Bellingham and Blackstone MA. The majority of these are inspections that are being done because the property owner is selling their property and it is required that a Title 5 Septic Inspection has been done on the system within 2 years of title transfer taking place. This usually means that an inspection has to be carried out because it has been more than 2 years since one was last performed. It is important to note however that the septic inspection just determines the system’s current status. As further detailed on the Mass Gov Website:

“The purpose of the inspection is to determine if the system in its current condition can protect public health and the environment. The inspection does not guarantee that the system will continue to function adequately, or that the system will not fail at a later date. Therefore if you are buying a property with a septic system that has passed its Title 5 you need to be aware that you will need to continue to maintain your septic and there is no guarantee offered by a septic inspection that the system will continue to function correctly, especially if you have a larger family moving in or larger appliances because this will all result in an increase to the flow to the system. Cesspool Replacement to North Attleboro

Down to Earth Construction Services are doing a cesspool replacement for a customer in North Attleboro, MA today. A cesspool is a pit which acts as both a settling chamber for solids and a leaching system for liquids. The use of cesspools may overload the capacity of the soil to remove bacteria, viruses, and phosphorus, and to nitrify ammonia and organic nitrogen compounds. Over time, when the drainage area around the leaching pool becomes saturated, additional pools may have to be dug to handle the volume. Cesspools must be treated to avoid harmful chemicals from forming and also to empty the pool which needs to be done regularly. This makes cesspools have high maintenance costs.

In Massachusetts Title 5 does not require Cesspools to be replaced:

“only those cesspools that exhibit signs of hydraulic failure, are located extremely close to private or public water supplies, or otherwise fail to protect or pose a threat to public health, safety or the environment will need to be upgraded (310 CMR 15.303). The Property Owner is Responsible for Arranging Their Title 5 Septic Inspection When Selling

Down to Earth Construction Services has Title 5 Septic Inspection appointments scheduled today in Holliston, Canton, Sharon, Foxboro, and Stoughton MA. When you have a Title 5 septic inspection this is what is included:

 

  • General layout of the system components (location of the building sewer, septic tank or cesspool, distribution box and leaching field);

  • Type of use (e.g., house, school, retail space), Title 5 design flow, and whether the facility is presently occupied;

  • Analysis of the criteria specified in Title 5 that indicate system failure, and, for large systems, those which indicate threats to public health and the environment;

  • Water use records from the previous two years, if available;

  • A description of the septic tank, including its condition, approximate age, thickness of grease/scum layer, and other relevant information;

  • A characterization of the distribution box and dosing tanks with pumps, if any, such as condition and evidence of solids carryover or backup; and

  • The condition of the soil absorption system including, any signs of hydraulic failure.

 

We have found that many property owners who have scheduled an septic inspection do not know what it will entail because they have not needed to have one done before. Generally it is the seller of a property that is responsible to carrying out the septic inspection so unless you have previously owned and sold a property with a septic system you may not have previously needed to scheduled one.  This is made clear on the Mass Gov Website:

 

“The property owner or operator is responsible for arranging the inspection. The buyer and seller may change the responsibility for arranging the inspection prior to title transfer, provided that this change is put in writing and that the inspection still occurs within the specified timeframes.”
