“In order to ensure that septic systems (conventional septic systems, cesspools, and innovative/alternative systems) are protective of human health and the environment, MassDEP generally requires that systems be inspected when a property is sold.

When is an inspection required?
When a property is sold to new owners, or there otherwise is a transfer of title to new owners, with certain exceptions.
“Title 5 does not require a system inspection if the transfer is of residential real property, and is between the following relationships:
(1) between current spouses;
(2) between parents and their children;
(3) between full siblings; and
(4) where the grantor transfers the real property to be held in a revocable or irrevocable trust, where at least one of the designated beneficiaries is of the first degree of relationship to the grantor”.

Title 5 Inspections And Voluntary Septic Assessments In Massachusetts

Down To Earth Construction Services wishes everyone a very happy 2018! This year promises to be even more successful than the last and we are already very busy with septic appointments for our customers. Today we have Title 5 Septic Inspections scheduled for customers in Rochester, Freetown, Lakeville, Berkley and Dighton MA.  Most of our septic inspections are required because a property owner is selling a home or business that has a septic system and is not on town sewer. However today we are also doing an inspection for a property owner in Acushnet MA who has requested a voluntary septic assessment.

As Stated on MA Gov website:

“A system owner may choose voluntarily to have an assessment of the condition of the system even if there is no requirement for an inspection. Results of these voluntary assessments are solely for the use of the owner, and do not need to be submitted to local Boards of Health or MassDEP.”

Many property owners are unaware that they have the ability to hire a licensed inspector to perform Confidential Voluntary Septic Assessments of their septic systems. However if you are hosting large gatherings it is a good idea to consider your septic system’s limitations when you plan a large event at your home. We have one customer who has a small property with a correspondingly small septic system. However they regularly host large gatherings of friends and family which puts a huge strain on their septic system. They have found that it is more cost effective to hire portable toilets for their events than to have their septic system pumped much more regularly due to the excessive use it gets when more people are using the system. This also reduces the likelihood of associated repairs and failures caused by a septic system that has not been pumped when required. Down to Earth Construction Services has extensive experience working with customers with cesspools on their properties. A cesspool is a pit which acts as both a settling chamber for solids and a leaching system for liquids. The use of cesspools may overload the capacity of the soil to remove bacteria, viruses, and phosphorus, and to nitrify ammonia and organic nitrogen compounds. The Massachusetts Office of Energy and Environmental Affairs do not require cesspools to be replaced however they do need to be maintained or if they exhibit signs of hydraulic failure, are located extremely close to private or public water supplies, or otherwise fail to protect or pose a threat to public health, safety or the environment they will need to be upgraded. What To Expect When You Have A Title 5 Inspection

Down to Earth Construction Services have licensed septic inspectors who are available to carry out Title 5 Septic Inspections for property owners who require an inspection. Often we are contacted by property owners who have a septic system and are planning to sell their home and need to have a Title 5 Septic Inspection completed before they can transfer Title. Once a septic inspection has been done it is valid for 2 years so they is no reason not to have it done as soon as you decide to sell your property to prevent any hold ups later in your sale and once it is done it is a positive point for your property. Often property owners have never needed to have an inspection to be done  before so this information from the Official Website of the Executive Office of Energy and Environmental Affairs helps explain what to expect:

 

“An inspection shall consist of the collection and recording of the following information:

 

(a)   a general description of the system components and layout;

(b)   quantification of the source/type of sanitary sewage.  This should include type of use (domestic or commercial/industrial) as well as the design flow and whether or not the facility being served is occupied at the time of the inspection;

(c)   an analysis of the factors set forth in 310 CMR 15.303 (failure criteria) and, if the system has a design flow of 10,000 gpd or greater, 15.304 (threats to public health and environment);

(d)   water use records for the previous two years for facilities served by public water supply, if available from the supplier;

(e)   a description of the septic tank including:

1.   approximate age, size, and condition of the tank;

2.   distance between bottom of grease/scum layer and the bottom of the outlet baffle;

3.   distance between the top of the scum layer and the top of the outlet tee;

4.   thickness of the grease/scum layer;

5.   depth of the sludge layer and distance from sludge to outlet tee;

6.   physical condition of inlet and outlet tees;

7.   any evidence of leakage into or out of tank; and

8.   any evidence of backup of effluent.

9.   a characterization of the distribution box, and of dosing tanks with pumps, if any, including: a.   any evidence of solids carryover; b.   leakage into or out of the distribution box; c.   whether the flow is equally divided; and d.   any evidence of backup.

10.   a description of the condition of the soil absorption system including: a.   any signs of hydraulic failure; b.   condition of surface vegetation; c.   level of ponding within disposal area; d.   encroachments into disposal area; and e.   other sources of hydraulic loading.

11.   the location of private water supply well (if any) in relation to system components; and

12.   a copy of pump-out records on file with the local Approving Authority.”

Irregular Pumping Of A Septic System Leads To Drainfield Problems

Down to Earth Construction Services is experienced diagnosing and repairing septic systems and leach fields/ drainfields. We have been called in for a drainfield repair in Marshfield MA which has been caused by irregular pumping of the septic system. A septic tank should be pumped every 3 – 5 years depending on various factors including water usage and tank size. If the tank fills up with an excess of solids, the wastewater will not have enough time to settle in the tank. These excess solids will then pass on to the drainfield, where they will clog the drain lines and soil. The property owner called us concerned because they had liquid puddling on their drainfield and sewage smells coming from it.
